How about this. Let me mod the game like I did for all the other ES games. I'll just give myself levitate and the bow of 1000 deaths and 1-shot every veteran dungeon boss with my awesome skillxorz!

When this system goes live, there will probably be a lot of chaos and annoyances. People will enjoy murdering NPCs and hunting murderers and all that.
Then after a few weeks, all the murderers will realise how much gold they are losing in order to maintain this criminal lifestyle, and they will go back to playing normally or they will be a lot more selective with their assassinations, either way, the atmosphere won't be ruined.
ESO could use a few murder sprees now and then, and there will be just as many players killing the murderers, so it will be fine. I really doubt NPC killing will happen frequently anyway, at least after the system has been out for awhile.

yeah... this is definitely a concern of mine. This was one of the main reasons I would end up reloading and redoing things a bunch in Skyrim - accidentally hitting an NPC that I hadn't meant to attack because they just happened to get in the wrong place at the wrong time (happened so much with AOE spells). It was really annoying - like if you tried to help the guards against the vampires in Dawnguard and accidentally hit a stupidly brave viliager instead and then the whole town comes to slaughter you... Or when your essential quest follower turns on you because they were stupid enough to keep jumping in your line of fire.... yeah... not fun. But we can't just reload in ESO when an accident happens like that. First of all, this is not an ES thing. Its an MMO thing. Since Ultima we could kill or raid towns, this isn't new or bound to ES.
We even could do it at WOW, before the care bears started to tell us how MMOs work and that we were only allowed to kill guards or other players in BGs.
Secondly,
if players can not kill important NPC´s, then the whole justice system is going to be dead. Why should someone risk a bounty with all the consequences for a totally pointless NPC?
Last but not least,
players who commit a crime will be flagged for pvp, attacked by guards and this will stop griefing. Just keep in mind, if you cant pay your bounty of 10.000 gold then you will be flagged forever!
I don't think it will be possible to play being constantly flagged, after all the banks are in town and if you cant access those due your bounty, you are pretty much screwed
