Sleeping NPC are almost always «aware», so you can't steal or kill them as long they have both that status and that eye isn't closing completely.

It wasn't always like this, so it's actually a bug (which I forgot to report, so I'm grateful for this thread).
It changed with Elsweyr update (or one patch earlier before Elsweyr, I don't remember exact month when I started noticing it)
Same NPCs which I used to pickpocket (and then use Blade of Woe) became immune to it. Also some not sleeping NPCs became glitched as well. For example, I used to be able to perform those actions on two dancing drunkards at Hardran's - after update, when I'm hidden and press "E" to pickpocket on any of those two, it opens dialogue prompt instead

Same as with some NPCs who are actually standing. You can be behind and almost touching them but if the game decides it can't find the proper angle (usually elevation related) you can't blade of woe them. Or the prompt appears but the animation is aborted.
