As for the emperor skill line, it doesn't cost points because the passives no longer have any effect while you are not emperor. (previously it did and used to cost skill points)

I get your point. Is an argonian more argonian at level 50 than at level 1? Not at all.
If you go for this explanation, then taking the soul (personality) away would only make sense, if it results in the complete absence of any racial property until it is returned to the character. But that would obviously be unacceptable to many.
Or another way you could see it;
the soul of your character was stolen & with that they've also lost a part of themselves.
So,considering the story of Eso it actually makes some sense that an argonian is more argonian at max lvl.When they've gathered skyshards.
Perhaps the effect of getting your soul back is a bit underwhelming at the moment & that should have unlocked new potential for each respected race?
If that would "make the vestige whole again" and thus unlock new racial progression options,that would have been pretty cool,imo
