I'm pretty sure, ZoS had to set this spot up at least nine months ago (when the trial was still in the injunction and writ filing stage) They had no clue if they would win or lose then.

I'd actually agree with that conclusion. Zenimax isn't hurting right now that's for certain. They pull a ton of revenue from consoles. Far more than PCPC and PS4 (bring back character transfers please?)
