I have read the Terms of Service for ESO and ESO+. I am aware that they state access is not guaranteed.
However, as clearly acknowledged within the Terms themselves, these limitations are “subject to applicable law”.
Under the EU Directive 2019/770 a paid digital service must meet basic standards of availability and conformity. These are mandatory consumer rights and cannot be waived or overridden by a private contract — including terms of service.
So while ZeniMax may legally include such disclaimers in its ToS, they do not exempt the company from its legal obligations under European law, which protects consumers from paying for services they cannot access or reasonably use.
Therefore, I maintain my right to request compensation for the repeated service disruptions, in accordance with applicable consumer protection laws.

It's entirely your choice of course, and we have no idea what your situation is, but if you need to wait for your salary payment to be able to gather a few tens of dollars to spend, it sounds like you might wish to reconsider whether a purely cosmetic item for a computer game is really the best use of your funds? Naturally value and enjoyment are different for everyone, and this is coming from someone who just doesn't think this cosmetic is worth this amount of real-world money even when one can easily afford it.
I totally agree with this and I don't understand what problem other people have with it. I think it's very well put and polite. I guess, some people have spent way too much money on cosmetics in games and are easily triggered when they see something reasonable that contradicts with their lifestyle choices.
