When it was broken someone found out that you could activate it and spam bash to get it to cast, is this an indicator that the code isn't properly stopping casts even though it should have been in this case?

I'm not nearly as confident as you are. What exactly from your past experience with ZOS makes you think this will be fixed "most likely within a few hours"? Seriously. We are lucky if broken spells get fixed within a year, and I'm not exaggerating.
