Well, EU law says you are a fool.

Quote EU law that states you can override a binding contract where the goods of sale have been delivered.

EU consumer law is actually quite strict and very in bias of the consumer. If you advertise something as coming as part of a sale, bonus or not, then a company is in breach of contract if they don't supply it.

It does not matter what their t&c's say and people spamming them are wasting time. As in the EU t&c's can't override consumer law. If a company does not provide what they advertise it is basis for a refund. As terms saying we may not be able to supply it actually, after selling it as a bonus and thus part of the purchase contract. Would be deemed an unfair condition, with regards to the consumer purchase and voided.

Which is why I think people have been getting hassle free refunds from Zenimax today. It doesn't bother me personally. But EU consumer law, I would say is the best in the world and people are right to mention it. As it would be on their side if that's what they want to do.

Their ToS are pretty water tight, you got what you paid for and they also state in the Tos that the game is not guaranteed to be available at all times nor do they promise too.

This is not the 24/7 service people think it is, infact its far from it and its in the ToS saying so. People should read more and type less then we wouldn't have these brain dead moronic threads popping up all over, like this one is more important or contains more information than the one that came 5 mins before.

You should ask ZeniMax how much they've got with pre-orders, but I'm not sure they are willing to share the data. ZeniMax announced some extra service to those who pre-ordered the game.

Not delivering is very likely to be considered unfair by EU law and thus the terms are not binding for consumers.

You might wanna check the EU webpage for Consumers Law, since you have some spare time, now eheh.

Said this, everyone here has the right to refuse the terms enforced with the update and ask for a full refund (zenimax terms of service).

I honestly imagine they will compensate users with some free time or in-game stuff (something worth 10 euros?). Each paying user they lose, it's a 12 euro * 12 months * N years loss they can't afford.

All Early Access customers will be granted an extended grace period until Sunday at 8AM EDT/12PM GMT before they are required to transition their account to live. This will cover online retail customers who didn’t get their boxes shipped in time and also give digital customers more Early Access time.
