From time to time i encounter bind-on-pick-up set items in guild stores (especially jewlery - for example viper's)...how does that work exactly / why can they be sold? Are bopu items somtimes boe?

It's one of the easiest ones, just tell your group you're looking for viper at the beginning and they will most likely give you pieces. You can get a full set fairly quickly, there's even a unique dagger.0 -

That's not the case here.
Some sets were originally BoE. When they were made into BoP in One Tamriel in 2016, the change was not retroactive. What this means was for sets like Worm, there are two different versions of each piece. The ones from before OT are BoE and remain BoE. The ones after OT have entirely different codes and are BoP. In the case of Worm, the new items even have different names ("of the Worm" for the original BoE pieces, "of the Worm Cult" for the new BoP pieces).
Sets like Worm, Ebon, Viper, etc. all fall under this category: the BoE pieces pre-OT have different item codes and remain BoE. They just don't drop any more and are increasingly rare.
What @F7sus4 described is a different, unrelated issue and is not at all what the OP is describing. Some BoP pieces were marked as BoE in the itemization table. When they fixed this, it was retroactive. I.e., a BoE Well-Fitted Alkosh shield, when it was fixed to become BoP again, retained its item ID, so the BoE->BoP change was retroactive and affected all copies of the item in the game. Items that had already been listed in a store or sent in the mail would become bound the moment they entered someone's inventory. This means that these mistaken-BoP pieces no longer exist--once 30 days have passed and the item expired from the store listing, they could not be relisted since they would become bound as soon as they entered inventory. Well, only the gold rings/necklace that are of "overland-character" are BoE. Sunderflame is a dungeon set so therefore not BoE.0 -
