I would say it wasn't the 40-60 into the mail that got you banned, but those in addition to the previous mails you sent. The system automatically social bans for a set number of mails exceeded over a specific time period. Most of the time you just have to wait it out, it may be a longer wait if you were recently, previously social banned, not sure.
As to the necessity of sending mass guild mails, I would argue that you do not need them. I run a large trading guild and very rarely send out mass guild mails. (last one was due to the addon/api issue a couple of weeks ago and a year since the one before that or more) Once you have things established in your guild, I find you don't need to spam members. They have access to everything they need with a faq, motd and socializing in the guild channel. Totally imho btw.

2 of the accounts thqt got banned i rarely if ever send guild mails from and they still got banned. I typically send them all from one account and if that one qas the only one banned after 40-60 mails i would understand but when i moved acco ts and tried to send the mail again that account was banned withing the same amount of mails.
Congrats on your successful guild and like you i try to minimize mails but this issue goes beyond that and extends to a lack of communication after 4 days and zero responses to tickets
That said, oh how I hate all those mails. Why does being a member of several trade guilds mean getting bombarded with bulk mails? I instantly delete them all and wish those addons didn’t exist. Use the MOTD, and ideally put all the info about the events for the week in a single MOTD posted right after trader flip.

We do use the MotD feature, and for myself, it typically gets updated about once a week, after the flip. However, a greater number of my guildies can't be bothered to read the MotD, even when they first join the guild. So GMs use all avenues possible to share information with the guild to decrease the claims of not being told about xyz. We can't make you read the information, only make it available to you.
As for why being in trade guilds means getting lots of mails, running a trade guild is a lot more expensive than people realize, and costs have only been increasing through the years. So this means GMs are constantly begging for gold and item donations (for raffles and auctions) to float bids. If you dislike this level of communication from your guild leadership, then maybe you need to find more casual or less communicative guilds.

I don't think ZOS has a mechanism to "flag" specific accounts that would put a different standard (lowering the threshold for mails) that's more strict for you.
So I have to assume it has to be related to the specific mail addon(s) you used and/or other addons used at the same time. Something is obviously tripping the system.
1) The mails are being sent out too fast thus tripping some "spam" alert in the system
2) The addon is badly coded (or outdated) & doing something that is pulling a lot of system requests in a short period of time
3) Someone or multiple people are reporting you every time you send a mass guild mail
4) The very unlikely possibility that ZOS has your accounts on "probation" & is holding you to a different standard
Personally I use GodSend & never have an issue sending out a guild mail to 500 people.
As for the people saying they are not necessary... what world do you live in? Barely anyone reads the Message of the Day or About Us Section. I have tested this before by offering huge free prizes in the MOTD by just sending the GM a "hey" message.
Even when it comes to guild mails, many people just outright delete them without reading though fortunately a majority will still give it a glance. Only like 5 or so people will actually follow a web link.
Guild Mails are the 100% the best way to communicate important information to your members. For example, if your guild is changing your weekly min, you absolutely need to let everyone know. To ensure that you need to blast it everywhere; Message of the Day, Guild Mail, Discord, website, & in chat. However the Guild Mail will be the method that results in the most people becoming aware of the change.
Personally I make sure to mark my guild mails differently based on importance so that for members that are likely to just delete them outright will know when there is a mail that they have to read. It's a very simple modification, just include "READ THIS NOW" or something along that line in the subject, haha.
I have had a few people who usually just automatically delete all mails, realize their mistake just right after deleting it & message me asking me to re-send it. They saw "READ THIS NOW" just a second too late.

Personally I am for completely cut off the API access on everything, so the bots disappear also, the PVP scumbags and especially TTC which has implemented into the whole game the "Auction House" cancer which ZOS vehemently says doesn't want to put in game.

No seriously, is this like a real Ban or one of those kicked from game for over messages thing? I heard that was some kind of memory leak thing. Whatever that is?
