I would suggest your build is not your private information as anyone that watches you can see what skills you are using and get an idea of how you are using them. Further, the ToS basically states it is not your private information. Pretty sure it says everything in the game is the property of Zos, not any of us.
Second, they cannot know what gear you are using unless you tell them. There is no inspect in this game.
Third and final, unless you are doing great things in PvP or PvE no one will want to copy your build. At that , those that are really good players often are happy to share their information with you. They may not share what they do to get the #1 vMA score but their overall build and suggestions they will often share willingly. I know because I have had many conversations with players of top teams on their build and related topics.
So I really would not be concerned as there is nothing to be concerned about.1 -

Your UserID is not logged if you are Anonymous. It is only logged if you turn off being Anonymous in-game. The only person who does that is someone who wants to be logged.

✭It is not an issue. I use ESO logs for every dungeon run. It's a great tool to analyze healing, damage, etc. Can I see what others are using? Sure. Let me get on them for not running the best gear or Abilities! /s
As others have posted this violates no privacy laws at all. Why? Because we all agreed to the T.O.S. which negates any privacy in game play.
This tool is a great addition to the game.

As much as I dislike the existence of ESOLogs, the only datum that is covered by EU law that might possibly be collected (I don't know if it is or is not) would be IP Address.
EU law does not cover video game builds or damage parses.
