DIGITAL PRE-PURCHASE BONUSES + EXPLORER'S PACK
5 DAYS EARLY GAME
ACCESS
Note the word BONUS.

For pre ordering the game (buying the game before release day) you were given a BONUS of 5 days early access, not included in the price. It's just a little BONUS for pre-ordering the game.

Stop complaining about something you got for free (5 days early access).

Not according to EU law, it isn't. This is a sale incentive and as such integral part of the deal. In addition, this is not a pre-order but a pre-purchase.
  • seangcxqb14_ESO
If they knew it would be intermittent, they should have specified that when people paid for it.

You don't get anything for free in this world. Early access is part of the deal. It encouraged people to bind their money months in advance.

Just because you call it bonus does not mean you don't have to deliver. People paid for it.

You didn't get it for "free". The requirement was to purchase the product early.

Money has a time value. If you won the lottery today and were given an option of $1 million today or $1 million at some future point, you'd take the today option. I use money at a higher scale than an individual because while the money doesn't seem that much to you, when you multiply it out by tens and hundreds of thousands of people then it actually is worth a great deal.

The Early Access "bonus" was an incentive to purchase something. Like if you signed up for a checking account at the bank and they gave you a "free toaster". You should still have every expectation of your "gift", "bonus" etc working correctly.

European laws are pretty clear about purchase incentive actually. It's not considered a bonus at all.

Actually, you kinda refuted yourself up there. Yes, it says it contains Explorer's pack AND bonus AND early acces, just as you say.

Not really no. The way it is worded I get Digital pre-ordered bonusses + Explorer pack + 5 Days early access. So no the purchases included early access.
Also nowhere does it say UP to 5 days of early access. It says 5 days early access.

Even IF you are right there is no reason why the word Bonus would imply that it should not work. You get it; it should work. There is no wording here that states that the access may or may not work.

On multiple levels you are pretty much wrong. By your logic you purchases a load of 1's and 0's which may possibly be a game that you might possibly be able to play. I am not sure I wanna live in a world with so many uncertainties.

It should always be noted that there are no free "bonuses" in sales. It might be discounted so as to keep the total price of the package the same, but it is not a free bonus. Think of it like part of your payment is going to keeping the server going during early access. These were incentives for investing in the game pre-release, and as such are not free, just packaged.

But I also don't think that the down time is severe enough to worry about. It is always prime-time somewhere and unless every MMO goes the way of GW2 with no true down time, patches and updates will always effect SOMEBODY's prime-time.

Not according to the law in the US. If it's advertised as included with the game for the price you pay. The word bonus does not mean you may get it, or we are being nice and including it. It means for the price you are getting an added feature those who did not pay as much are getting.

This would not even be difficult for a second year law student to argue

The EU is so great they tax you for playing video games. Or the charge you by the Mb for internet. Great place that.
  • Timowadeb16_ESO
Guys calm down :) The only thing im unhappy about is the lack of notice for downtime. Nothing else, just give us more notice and explain why such things are happening like the guild shutdown and mail shutdown..

I agree, but at the same time I feel the complaints are justified. There is certainly better ways they could handle maintenance, then the way they have been. It's like they treat every maintenance as an emergency one, even if it's planned.

Er, pre-order and pre-purchase mean the same thing, any semantic differences you care to waste your time arguing vanish once the item is delivered which it has been legally.

Also, unless the pre-release price is higher than the normal price it would be hard to argue we PAID for any of the Explorer's Pack which ES is part of.

The EU 'law' being referred to doesn't say what is being asserted.

In some of their ads they just advertised (only) the early access - so does that mean the other items were bonuses then?

If people wanted the early access part then that is what they paid for. You don't own the game only the right to play it so having early access to play is as tangible as anything else.

If you are so blinded by the words "bonus" and "free", you clearly don't understand how the world works, NOTHING is truly free or bonus, those words are used as an excuse so they don't get punished for messing up that specific item they claim as "free" or "bonus".

It was a bonus to THEM to receive full payment in advance of release from me.

It was a bonus to THEM to receive and extra $20 from me for a collector's edition.

    exactly...extra..therefore it was a bonus.

the early access is purely for marketing, to get people to pre order the game. There won't be a 5 day early access bonus tomorrow because it's already happened!

It would only be a bonus if you could prepurchase early, but make your payment on 4/4/14.
This is not the case, so it's not a bonus. Quit whining, they offered us something which they failed to provide.

Just because people pre-ordered for the benefits does not mean they didn't spend more than they would have elsewhere to not get the same benefits. That makes the purchase through the chosen method something you've paid more for.

There is no way the game would have been £50 on release in most places. In fact the game is £35 on Amazon UK. That's actually a huge mark up for early access and the benefits that came with it. To look at the Imperial edition is another £20 (£70) which is the cost of two copies of the game elsewhere. To take away 4 hours of the benefit in EU prime time is actually meaning we may have wasted some of our money.

Depends on how you look at the wording.. You take it to mean 5 days of early access... Whereas it could also be taken as you get to start 5 days early. The latter criteria has certainly been met.

    Actually, I'm right.

The pre-order bonus items were stuff given to you if you pre ordered the game. The act of pre ordering the game gave you these unique items, the same as being given free coupons if you buy 10 or more rolls of toilet paper. Can you get these items in game if you buy the game say next week? No, because they aren't included with the game.
