An exploit is more of a glitch, a hack is using a device to corrupt ones data
still not hacking. its exploiting because its using third party software to exploit a client side memory addressing issue (possibly cooldown timer.. don't know) by injecting new code to that memory block to gain advantage. If the control on that was done entirely server side then yes it'd be a hack.

A short ban, followed by a permanent "Cheater" title on all their characters. Then it's not that they can't play at all. They just have to be publicly reminded of their shame for the rest of their visits to Tamriel.

There is nothing more annoying. Your option even saves them the time to grind and any negative effect on their account does nothing than equal a perm ban cause they won't put up with it. So... great idea.
