If anything, in other games I have gotten perma ban for smaller things. If you feel like ZOS is nice about it then a month ban servers them. But you forget ZOS PERMA BANS people for ACCOUNT SHARING which is just as bad in their eyes.

you seem to forget the underlying system of justice which is the basis for any constitutional democracy. innocent until proven guilty? 3 strikes and you're out? you know those phrases which have been coined and derived from the fundamental laws that underpin our entire system of society and justice?
terms of service a law binding contract? pull your head out of your arse. A Game Developer does not write the law. They merely write terms of service which they can at their discretion choose whether or not to deny you access to that service on the basis of that. the terms of service are not law, they are a guideline to do's and don'ts that ZOS set that gives them some level of legal standing in case actions of actual law were brought against them.
here's the reality. in most western countries there is actual law (that has passed through two levels of parliament, or congress or whichever system of capitalism you live under) governing consumer transactions. In Australia in particular there is significant legislation pertaining to this and 'Refusal of Service' under that law. For example lets say Netflix banned me for using a VPN Service to access American content. Despite their TOS, I could in essence sue them for unjust refusal of service and more than likely win under the protections given in the Consumer and Competition Act 2010.
Also in those cases, like any legal prosecution - it is the onus of the service PROVIDER to prove guilt. Good luck with that.. Video from another player would almost be borderline inadmissable. Logs of Code Injection attempts from Client -> Server side.. that would be harder evidence.. Using the Netflix example - Netflix would need to PROVE that i was using a VPN provider and that I was not in the country at the time I accessed the service.. You really think they'd go to all that trouble over $14.95 a month?
THAT is why you will not see massive permabans. A TOS is a safety net. Not legislation. Whats easier and far less costly.. ignore the rabble rabble rabble of the masses knowing full well that they won't quit their game subs despite all their screaming and shallow threats that they will. Or fight an exploiter in court over breaches of Consumer legislation with little no no evidence to support their case against the exploiter..? (and possibly end up paying hefty fines and defence legal costs in the process)

they're not hacking.. they're manipulating code injection on the client end through an authenticated connection. that's exploiting. if they are hacking, they are directly using injection at the Server end to gain unauthorized access to functions otherwise disallowed.
that then becomes a criminal issue.. not TOS..
how? you cannot trade / transfer crowns and neither you can trade anything you buy from crowns. you MUST have taken a way through real money. not the perfect example of undeserved bans, rather those that deserve bans making up stories as usual

An exploit is more of a glitch, a hack is using a device to corrupt ones data
