I find it rather humorous how before you could loot any and everything and now it considered stealing, you have to be real careful now.

Actually there is no risk if you go to the Hollow City, Coulharbor, or go to certain locations with a ton of crates, etc. Though I do enjoy challenging myself by looting things in small rooms with guards nearby.
Definitely should have tried to be more discrete in his misdeeds.... ah well, he only has a 64K bounty leftI was speaking to a guildy last night, his bounty was 100K. He had 36K in gold on him at the time, unfortunately he met up with guards that had 6,000,000hp They took all his gold, and he still has a bounty on his head.
I got the impression over TS he wasn't exactly happy.

That's an interesting point actually. I agree with ZOS that the guards shouldn't take gold from the bank, but what could happen instead? Should it be that the bounty does not decay over time at all (or decays much more slowly) so it's not so easy to get rid of? Maybe set it so that it can only decay while logged in on that character, and cannot decay while you're not playing? It would be good if there were also some "free" ways to clear your bounty, like community service. Jail would also be an option, but as others have said, I'm not sure how jail would work in a persistent world. Exile could also be an actual option on the guard's dialogue; you get ported to the middle of nowhere, and by the time you get back, your bounty will have decayed some. (If it hasn't decayed enough, you get immediately arrested again.)
I say drain the accounts. You want to discourage random murder sprees? Add consequences. And since gold is the only real consequence that seems to get people's attention, that should be where they get hit.
You could also hit them in the eXPees. (I guess that could be the equivalent of previous TES "jail time".) Some amount of progress to the next skill level in some skills is wiped. (Any maxxed skill is dropped to 49.) The number of skills affected is proportional to the bounty value.

I really don't understand how it's a gold sink... One of my biggest concerns with the justice system when I played around with it on PTS (that was probably around 1.6.1) was how ridiculously easy it was to make a ton of gold in a short time. I was making 10K or so in about 15 minutes, even taking into account paying off bounties. It's only a gold sink if you're a bad criminal and keep getting spotted. Otherwise, it's a huge gold-earner.

Yesterday I came back to this game after a long hiatus, and as I was doing a quest in daggerfall, an assassin attacked me as part of a quest. While I was killing the assassin, I accidentally hit a guard, since he pretty much went right in front of me while I was defending myself. Thus, the guards started chain killing me...over, and over, and over, and I couldn't pay off my bounty since I had 0 gold. I even tried leaving the city to avoid the chain killing, but died several times in the process. Thus, I got frustrated, logged off, and went back to guild wars 2 for the night. I can see this situation happening to several new players, and it may seriously hurt Zenimax in their push to get a new or returning wave of players in this 1.6 patch + tamriel unlimited.
My suggestion would be to put in an introductory mechanic or tip system for the justice system, and maybe a one time "pardoning" or something along those lines, for brand new characters, so that level 3 characters with 0 gold do not get perma killed and don't know what to do except for log off.
