I would consider it a spy. We should be able to portray him on a stage in front of an audience and have the axe man cut off his head for all to see.
The concept of a spy is a difficult one. Having a friend roll a character in the opposing alliance to report on attack plans and "troop movements" seems like it would be acceptable to me, that's fairly realistic and now that we know it's happening measures can be taken to avoid revealing important data too early.I would consider it a spy. I agree with you, but I think the real issue is that once we discover a spy, we can't attack him, boot him from the alliance, etc.Wait, the age old "send out some bait and lure them into a trap" tactic is being thought of as an Exploit? Armies have been doing this since the dawn of organized warfare.

The problem with the idea of a spy is just like what is mentioned above. Leading opposing forces to your alliance's FC, or to where they are hiding, or picking up your alliance's scroll to take to your friends in the other alliance: all of these are serious violations of trust and the undermine the key ideas behind how PVP is supposed to work.
But it really is a problem of enforcement. There's nothing in the game as things are to prevent these things from happening and continuing to happen. And any correction to how PVP works would be needlessly complicated. So we're back to reporting players and that whole process...
What would we do to fix it? Best case I can see is allowing players to accuse other players of being spies. Once they hit enough reports they're kicked from Cyrodiil until their case is reviewed by GMs. There would have to be penalties for false reports or else every AD on Haderus would accuse Fixate of being a spy
I just don't know if there's a good solution.

ZOS will have to decide how they want their game to be played. One thing I want to make sure everyone is aware of is the atmosphere in EVE. The paranoia runs heavy and deep in that game the moment you log in the first time. They have given players tools to spy but also tools to root them out.
Betrayal has made it's appearance on several CCP youtube promotional videos.
