you waive your right to that the moment you clicked on agree for the TOS. Really people you need to really learn to read the TOS before agreeing. It's a contract for a reason and it's a smart idea to actually read it and not scroll to the bottom just to make the agree with button appear so you can play the game.

Im starting to think internal sabotage.
No professional company with quality control and testing could introduce this many problems with already working content. Could it?

ZOS is not legally obliged to compensate us for time we haven't been able to have "expected" performance. Honestly if they have sent u this kind of e-mail it means that this game for sure is going down coz guys dont know what they are doing. Even if it is their legal position they should consider fact that they have to have satisfied customers if they want to get their investment back in long run. And they dont. Obviously ZOS organisation is still in denial phase and still hoping for miracle which will not happen on its own.
Only solution is that some ZOS key people pack their personal stuff and go home on well earned break from work coz they put their ego before best interest of customers satisfaction - their company well being.
I know for the fact that i had 301 twice and couldn't loggin on my EU chars and couldn't progress for 4 days. Having fps issues since patch 1.2.3. ( more than 10 days ) and really cant play end game (cyrodiil and craglorn). All in all i couldnt play as expected for more than 15 days.
ZOS as service provider in my opinion is simply terrible and wouldnt ever do business with them again after i take from this game what i need.
Simply they are not business smart if they are waving with legal documents in this situation.
Just to give u more insight about whats ZOS position on extra time i will say this :
had one e-mail communication with ZOS superb CS where i asked them to credit me for game time i lost coz of fault on their side - they said to me that i couldn't benefit from extra game time coz game is not functional anyways ...
All those "protectors" who would like to have discussion with me regarding quality of CS - please take your shot .... just dont please expect easy win and come prepared ...

What I meant with my comment was that if some players can play and some cant.....might take longer to debug and stable our game?

The above quote is Very important information and should be forwarded specifically to the Engineering team looking into the FPS drop issue.
The above info paints a Bullseye on the source of the issue.
The Engineering team should be able to take one look at this and be able to quickly discover the source of the problem.
Quick rundown: This is indicative of graphics processing, co-calcs and rendering being pushed to the CPU, rather than the discrete GPU. This increases CPU load, causes the GPU to under-perform, and may cause additional cascade issues that I will not list here.
Anything more I could say on this issue will be well know by them, so I will leave them to it.

Additional info: For the purpose of immediate replication of the issue and data: The screenshots in the quote are definitely from the ASUS "GPU Tweak" and "Monitor" utilities included with the ASUS GTX 760 OCII 2 gb card.

Sound logical, only problem is not even 1 CPU core is maxed...

What I believe could be the issue: A conditional forced GPU 'wait' while the CPU processes.
This creates a major bottleneck, causing the GPU and CPU to lose parallelism while creating the staging buffer, and only occurs when specific conditions are met.
The "ping-ponging" between the CPU and GPU is overridden with a forced wait, creating severe latency in the internal processing, and creating the possibility of a number of cascade issues.
These issues would include, among others, frame lockups, very low FPS, general instability and the appearance of ability lag. The severity of the cascade would be dependent upon the number of times the 'condition' state is met within a short amount of time.
This is a common issue, and best solved by the Engineering team.
