Update On Endeavors Resetting Issue

To answer the question - yes, we all agreed to the ToS.
That does not mean that ZOS does not make mistakes like in this case where people get banned first and then get their account reinstated later. And that people are upset is something to be expected and therefore it should be discussed so it won't happen again. Like players ZOS can make mistakes.

And in general if people don't want to see posts popping up in their feed it can be changed in the notification preferences in the profile tab.

Guildmate still not back in game.

Got the emails saying all fine with their account & the account unlocked/unbanned.

But they can’t get back in the game - have sent in support ticket(s) but nothing happening.

Its now over 2 weeks. Please give Support a nudge @ZOS_Kevin.

Where I live consumer can't sign away their legal rights. Any contract terms against consumer laws or legal rights are void.

If people read the ToS, they'd already know this is a basic provision. I assume people who have proclaimed that "we all agreed to the ToS" as some sort of cop-out haven't fully read or understood them, or don't understand what Statutory Obligations are.

There are a few other things to note regarding the ToS. In every instance where it is mentioned that ZOS "reserves the right to revoke access," i.e. ban, or similar wording, it has a conditional; such as reasonable belief or if the ToS has been breached. They don't reserve the right to ban people willy-nilly. Reasonable belief, which is one of the conditionals in their ToS, is a tricky thing to work around. It's a legal term in a similar vein as reasonable doubt in a court. What it means is: in our subjective opinion you were doing X and anyone else would objectively come to the same conclusion. This conditional couldn't possibly have been fulfilled if any sort of investigation happened first.

So far as statutory obligations are concerned, for anyone still banned: since most if not all of the bans happened on an EU server we can assume they live in the EU or EEA (if you don't live in said area, there's not much you can do), use your right under GDPR to request all logs they gathered, observed, or used to show that you've been exploiting. If the logs show that you've only been doing the things you have been doing over the last few weeks, there should have been zero cause for them to ban you.

It's only 2 days. August 23 never mind. just saw that the one in 2 days isn't a patch

Are we sure? Because usually our update is 2 weeks after PC and our August 23rd banner says it is a maintenance and not a PATCH maintenance, which it would normally say if we were getting the update that day.

@BenevolentBowd, that is correct. That should be fixed when you patch to Update 39.

In some countries, having agreed with the ToS doesn't prevent a person from challenging it in court, especially if it's considered the terms are against consumer laws or consumer-related jurisprudence. Having said that, I must agree with SerafinaWaterstar in not seeing what your point is.

    [edited to remove quote]
Who is true, but rules in an game does not translate to law. You can not take an soccer referee to court for giving you an red card. Nor anybody who hurt you in the game as its an game. But you can be charged for assault kicking some who is down or similar gross stuff.
Grinding just make you go in circles.
Asking ZoS for nerfs is as stupid as asking for close air support from the death star.
