Most of the time you lose the right of withdrawal for digital content when get access to it, or start downloading it.
That means for steam activation a key/buyin it in store, and for some other stores the start of a download.
To quote the ZENIMAX TOS:If you are an EEA/Swiss customer purchasing Services or Content from ZEL which are immediately digitally delivered to you, you will be asked to consent to immediate performance of your agreement to purchase them and to agree that you will thereby lose your above right of withdrawal.

You lose the rights to return it under distance selling laws which are there to allow customers to review items at home as they've not had chance in a shop, however, your right to return digital content because it isn't working properly fully remains
but it is not working not properly.
You have access to Morrowind, Warden and everything included in the DLC.
They never promised a bug free game, a bug free computer game isnt even possible these days. with all the content and features.
Battlegrounds isn't working properly. It is sold as a feature of the update therefore, to me, that means it is not working properly. There is a difference between minor bugs and a major feature of the update not working at all.
If you're happy to pay for something which doesn't offer all the features they promoted, then fair enough. I wasn't and as a result received a refund
