No one is safe from Boobies. They control your life at birth. They are a source of distraction during puberty, A quest in your late teens until the time you pass from this earth.

Sir Andy While you are correct with your industry. Your methods fall under the eavesdropping clause of several of the above listed states "monitoring" does not have to include recording.

In Oregon you and your company could face felony charges. If it was found and proven that you Monitored an Oregon Citizen or Corporation with out a Warrant.

"(1) Any aggrieved person in any trial, hearing or proceeding in or before any court, department, officer, agency, regulatory body or other authority of the state, or a political subdivision thereof, may move to suppress the contents of any wire or oral communication intercepted under ORS 133.724, or evidence derived therefrom, on the grounds that:
    "(a) The communication was unlawfully intercepted;
"(b) The order of authorization or approval under which it was intercepted is insufficient on its face; or
"(c) The interception was not made in conformity with the order of authorization or approval"
ORS 133.724 provides in pertinent part:
"(1) An ex parte order for the interception of wire or oral communications may be issued by any circuit court judge upon written application made upon oath or affirmation of the individual who is the district attorney for the county in which the order is sought. The application shall include: * * *."
ORS 165.540 provides, in pertinent part:
"(1) Except as otherwise provided in ORS 133.724 or subsections (2) to (5) of this section, no person shall:
"(a) Obtain or attempt to obtain the whole or any part of a telecommunication or a radio communication to which such person is not a participant, by means of any device, contrivance, machine or apparatus, whether electrical, mechanical, manual or otherwise, unless consent is given by at least one person.

The Oregon statutes define an "interception" as "the aural acquisition, by listening or recording, of the contents of any wire or oral communication through the use of any electronic, mechanical or other device."

Nastuug don't rep your self get a good Civil rights attorney who can wield the 1st 4th and 14th Amendments like Sword Singer wields a sword.

Dang now I'm thinking about Boobies

You mute them just like you would in text chat. I know this all seems very new and mind blowing, but this is the way console gaming is, and has been for years. If you want to understand how it works there is no mystery, put on a mic and start playing any multiplayer console game. Just like text chat in PC games voice chat is standard on consoles and works very well.

Chat filters are there to make parents that don't know any better feel like their kids are safe, but we all know better.

Agreed. I think ppl are just use to "the sky is falling" in this games forums.

Well, since i work in the audio and video fingerprinting space, i can tell you that this is certainly possible.

I can get you a match on a 10 second music sample against a database of 120,000 reference songs within less than 10ms.

If you fingerprinted every swear word in the English language, your reference set would still be much less than 120,000 and your query would be much shorter as well so performance could easily be in the sub 1ms range for detecting swear words.

That's fast enough to blank them out in a live stream like TeamSpeak etc ...

ya, i'm sure this is totally relevant and completely doable in an MMORPG "space". Sorry bud. It's not.

Well the game is rated Mature, so that is their way out really. If you don't want to hear adult language don't play an adult game.

While swearing doesn't bother me, there's a big difference between the odd swear words and some of the things I've seen in certain mmos text chat, much of it is anything but mature. The thought of those idiots shouting this stuff, it won't offend me but it's not something I want to listen to.

Not true if the audio stream is through a product where each user had to agree to a terms of service agreement, like TeamSpeak for example.
TeamSpeak could implement a profanity filter in their product without violating any laws at all.

The same goes for any other provider of voice chat for their products.

Sir Andy dont take it up with me Take it up with the State of Oregon or any of the above listed states. TOS is not and does not equal consent.

A concurrence of wills. Express consent is that directly given, either lira voce or in writing.

Law Dictionary: What is CONSENT? definition of CONSENT (Black's Law Dictionary)

Two Party Consent when all parties will consent to a wiretap that is needed in some states for it be lawful.

Law Dictionary: What is TWO-PARTY CONSENT? definition of TWO-PARTY CONSENT (Black's Law Dictionary)

Third party consent refers to a person's agreement to official action like search of premises that affects another person's rights or interests. Third-party consent must be based on the consenting person's common authority over the place to be searched or the items to be inspected. There are a line of Supreme Court decisions to the effect that in addition to the criminal defendant, a third party who shares common authority over the property with the defendant may also give effective consent to a search of the defendant's property.

You may know your industry but you do not seem to know the laws governing it. If filtering equates to buffering storing and analyzing the SCOTUS just shot that down

Internet forum lawyers , as amusing as it gets sometimes.

Boy I read every day about all those YouTube posters and Twitch stream saves getting in trouble with the law for recording other players without a signed triplicate consent form.

Well , I read somewhere someone said its true so it must be

We are not talking about recording in the context that you are thinking. A good example of what I mean. If you call me on my phone. Here in my state I do not have to inform you of being recorded. We can talk smack or something nefarious. I can use it against you. Now if I call you and record you without your consent its a class 6 felony mandatory jail/prison time and a hefty civil suit to boot. This is what I am referring to. I am retired so no issues from me. But I have seen plenty of idiots/companies and LEO's *** away promising futures simply by not complying with the law. Dahkoht try some civility when writing or communicating.
    Edited to add
Your comment was apples/bowling balls and fallacious

You can bet this is true FB is not going to like the Civil Suit from this

BTW Sir Andy is right on the filtering time its probably quicker with other patented versions but I don't think that he would use others IP without consent or if they will allow their IP to be used unless it was part and parcel. Micro$not has the capability they received their patent in 2004 in 2008 they were really thinking about it. But I think at the time it was tech constraints.

On console. No filter but if you're on Xbox one there is a very simple report feature found in the game profile. Because ZOS used the gamertag it pulls right up.

You can only hear ppl that are very close by so it's no issue as the volume diminishes as you or they get further away.

If you're on PS4 no idea. Good luck

I suppose that this is a bit like real life. If someone's speaking in a way you don't approve of then you can walk out of earshot.

It's a shame that real life doesn't have an ignore option that stops you from being able to hear some people though. Someone needs to invent one of those.
I'm a middle-aged gamer from Brisbane, Australia, who has enjoyed ESO since PC beta and now into the Xbox One version.
