My sister wants to play, does she have to buy a whole new game?

Or can she just download the client through my account and pay the subscription fee for a separate account (I bought the online version, not the tangible one)? Her wallet would be very disappointed if she would have to pay for another edition despite the fact that I have already done so, especially considering the fact that there's a hefty subscription fee on top of everything...

    Yes, she would have to both purchase the game as well as another separate monthly subscription plan along with her purchase to be granted access.

    If you don't want to play at the same time then she could just go 50/50 with you in a sub and you get 4 characters each.
    But if you want to play together, or at the same time then yes, she would need to buy it and create a separate account.

    I would guess that even though it is against the ToS it would not be illegal, legally speaking. If it was, then buying any video game, single player or otherwise would be illegal for other members of the household to play that game within the household. Same could be said for buying movie dvd and other media and others watching the movie that you bought.

    Oh I am not condoning any action other than you playing your own account.

    Most MMO have a "no sharing" clause in their ToS to prevent you from sharing your account between people across the world, but they typically don't pursue people for sharing their accounts with people who live in the same house because it's impossible to track that and also because doing so would be dumb.

    It's not "illegal" as in the cops will pay you a visit for doing it. But it is against the terms of service, and they can ban your account for it.

    You know what I find funny, you have parents that bought the game (for a child, teen or younger), set up account using CC and the child is the one that plays the game (but not the parent/s).

    Because the parent is the legal account holder, any child could not play according to the ToS. How many accounts would be closed if this was upheld by Zenimax.

    Parent's permission overrides that.. just like you can watch a R rated movie in the theater with a parent.. sigh.. :( [btw, I wish they would add a "roll your eyes" emote :D]

    In that case since a minor cannot be legally bound to the ToS, then how can the brother (if a minor) break the ToS by allowing his sister (a minor) to play the game on the same account? Im not talking about a parent allowing two minor children to play.

    Its not a debate. ToS is clear.
    We all know its been done in a household.
    We all know that children play.
    Time was things we knew that were not correct but allowed to exist were not spoken of out loud.
    Ultimately you come on here and admit in writing your breaking the ToS its completely in ZOS hands what to do.
    Yes that includes banning you.
    Doubtful of it though, but if they did, how are you going to appeal it if you sit here typing away that you are in fact doing it?

    You need the Standard game code to set up the account initially which gives the free 30 days, and requires subscription details though you can cancel before the subscription commences.

    So yes you still need to buy the game first to get the unique code. The game install itself can be copied etc. but it still requires an individual account.

    That can't be entirely true because said minor could not even access the ESO home page with or without parents permission. Besides, minors are not legally bound by any TOS so they can choose to break it. Besides, who cares, they can't play 2 characters at the same time. It would be fun to watch them fight over who gets to play and when. Survival of the fittest. Battle to the death.

    P.S. ESO is overpriced, if you do chose to buy a second copy for your sister, make sure you purchase it from a 3rd party site. You can get it for as cheaply as $45. Check out the link at the bottom of twitch.tv/likeaspeed6 the G2A picture will get you a copy for $45.

    Accounts are non-transferable under any circumstances. You have sole liability for all activities on Your Account and/or under Your user names. You may be held liable for losses incurred by ZeniMax or other third parties due to someone else using Your Account or password. Your Account or certain features of Your Account may be restricted, suspended, and/or terminated if someone else uses Your Account to engage in activity that violates these Terms of Service or is otherwise improper or illegal. You agree to notify ZeniMax immediately of any unauthorized use of Your Account, user name, password, or any other breach of security."

    In the first paragraph it states that we DO NOT own the account. However, in the second paragraph, it is clearly stated "Your account" which indicated ownership. Otherwise it would be " sole liability for all activities on the Account and/or under the user name." Also, it says nothing about sharing a CD key, only an account. Email them the holes in their TOS and make them allow you to use the game key which you purchased, so it is yours, to create a second account.

    Some people will tell you that you can't share your CD key because of this passage. "You may not (a) distribute, publicly perform or display, sell, transmit, publish, edit, reproduce, sublicense, rent, lease, loan or otherwise transfer any Game, Software, and/or Content, including without limitation any access keys;" But it actually is not because you did not have to agree to any TOS to purchase the CD key meaning that you are not bound by this section. Also, it does not say "share" only transfer or transmit, which are not applicable because you wouldn't be transferring the game anywhere, only sharing it on a computer that already has it downloaded.
