As per the title, just before I accidently got a bounty after dueling a Necromancer because my self-heal spell was still active after the battle while they got into a fight with a guard and my spell which was out of my control healed them and I got a kill on sight bounty despite never having gotten a bounty on her, why is this not an option like disable killing Innocents?

No way, this is a great feature to have to troll those people who go around spamming heals in town areas. I may or may not have intentionally or unintentionally used this 'skill.' :)

Maybe you missed the part about it being an "option"

They could just not allow duels within town limits.

It's illegal to heal criminals in ESO? It's a kill on sight bounty? Why?

It's annoying to receive a bounty for healing a criminal with a single target heal spell, but interestingly, area of effect heal spells — like Extended Ritual — will allow you to heal criminals without accruing a bounty.

Regardless, I agree that it should be a toggleable option (like the option to prevent attacking innocents), and I think that dueling within towns should still be allowed. Disabling dueling within towns won't prevent this problem — what if the criminal accidentally casts a Criminal Act spell within town, and picks up your healing? You don't know if people have a bounty, so you have no way of knowing whether trying to help someone out will result in getting a bounty.

I guess it may have something to do with preventing players from outhealing the damage the guards do — before the guards resort to one-shot kill abilities, that is. Imagine a ton of guards piled around one player, while several other players are healing the one player to prevent that player from ever being killed.

Thanks, that does make more sense as a justice mechanic than an ideology.
