Availability of Services and Content; Game Maintenance, Patches, Updates; Termination of Services
ZeniMax does not guarantee that any Services will be accessible or available at all times, in all countries and/or all geographic locations, at any given time, or that ZeniMax will continue to offer any particular Services for any particular length of time. Except as prohibited by applicable law and subject to the Statutory Obligations (as defined in Section 1), ZeniMax reserves the right to change and update Content without notice to You. ZeniMax also reserves the right to refuse Your request(s) to acquire Content, and to limit or block any request to acquire Content, including, but not limited to, Downloadable Content and Game Mods, for any reason.

ZeniMax may patch, update, or modify a Service at any time with or without notice to You. Notwithstanding the foregoing, ZeniMax has no obligation to make available any patches, updates or modifications or correct any errors or defects in the Services. ZeniMax makes no guarantees about the persistence or availability of any user names or other personas at any time and assumes no liability for lost or deleted Account data. Except as prohibited by applicable law and subject to the Statutory Obligations (as defined in Section 1), You agree that ZeniMax will not be liable for any interruption of the Services, delay or failure to perform, any loss of Content (including, but not limited to, UGC, Game Mods and Downloadable Content), and/or Account data (including, but not limited to, Character data) resulting from any causes whatsoever. ZeniMax reserves the right to offer new Services, change and/or discontinue certain Services at any time in its sole discretion.

Except as prohibited by applicable law and subject to the Statutory Obligations (as defined in Section 1), ZeniMax may restrict, suspend, or terminate Your access to and receipt, play or use of some or any Services at any time. Should ZeniMax make a material change to the Services, it will provide You notice within the time period specified when You joined the particular Service, or if no time period for notice of material changes was specified, then within thirty-five (35) days of the date such notice is either (at ZeniMax's discretion) provided to You via email or is posted on the applicable product or Service or on Your "My Account" section.

In response to a violation of these Terms of Service, ZeniMax may issue You a warning, suspend or restrict certain features of Your Account (including, but not limited to, user names), selectively modify or remove or revoke Downloadable Content at an Account and/or device level, immediately terminate any and all Accounts that You have established and/or temporarily or permanently ban Your Account, device, and/or machine from accessing, receiving, playing or using all or certain Services.

ZeniMax may terminate Your access to and/or receipt, play or use of the Services (i) for violating these Terms of Service; (ii) if ZeniMax, in its sole discretion, deems that Your information is untrue, inaccurate, not complete or incomplete; (iii) if Your access to or receipt, play or use of such Services infringes on or is suspected of infringing on another's rights or any intellectual property; or (iv) if You or Your Account reflects inappropriate Content and/or violates these Terms of Service. Any and all Content (including, but not limited to, Software, Content, and Downloadable Content) will be considered forfeit immediately in the event of any cancellation, closure, or termination of Your Account by ZeniMax.

If ZeniMax terminates an Account, it may terminate other Accounts that share the same characteristics, such as the name on the Account, email address, mailing address, Internet Protocol address, or credit card number or other Payment Method. ZeniMax reserves the right to use any means necessary and permitted under applicable law to identify and terminate Accounts.

You acknowledge that in such circumstances, ZeniMax is not required to provide You notice before taking action to restrict, suspend or terminate Your access to or receipt, play or use of Services, and/or Your Account. If ZeniMax terminates Your Account, You may not access, receive, play or use any Service again without ZeniMax's express written permission. ZeniMax reserves the right to refuse to keep Accounts for, and provide Services to, any individual. You may not allow individuals whose Accounts have been terminated by ZeniMax to use Your Account.

If Your Account, a particular Membership for a Service associated with Your Account, or Your access to or receipt, play or use of a Service, is terminated or suspended and/or if any Downloadable Content is selectively removed, revoked or garnished from Your Account and/or if Your device is temporarily or permanently banned from accessing, receiving, playing or using some or all of the Services, no refund will be granted, no Downloadable Content will be credited to You or converted to cash or other forms of reimbursement, and You will have no further access to or receipt or use of Your Account or Downloadable Content associated with Your Account or the particular Service except where any action has been taken against Your Account or device in error and subject to the Statutory Obligations (as defined in Section 1). If You believe that any action has been taken against Your Account or device in error, please contact Customer Services at help.bethesda.net.

But thats not what the op is arguing.

They want eso plus to be available constantly fir the full 30 day period.

    Which technically it is.

Its eso that is down etc ...

They are two seperate things really.

If the game is live but your not able to access exo plus then thats a valid complaint.

Except nowhere is it outlined that ESO+ members are somehow magically entitled to better basic game service than non subscribers. OP doesn’t have a valid complaint, esp considering that as @wenchmore420b14_ESO points out the overall TOS includes provisions that have players accepting downtime of any kind.

Agreeing or disagreeing with me? I am lost. Sorry

    To be clear,

You pay for all of the benefits that ESO+ entails ... for a period of time, dependent on the plan you choose.

At no time does the company guarantee that the game will always be up, every single day, 24/7.

ESO+ is a choice. If you do not think you are getting your money's worth, stop paying for it.

    IMHO

What @trackdemon5512 is saying, that we ALL signed the TOS and OP isnt a valid complaint.
Section 6 clearly states that we must accept any down time with out any compensation.
The OP says we deserve full amount of days/hrs of ESO+ covers, but that is not the case.
At launch, when it was sub based, ZoS did give us a few days of free time, but that was their chose, not because we were entitled to it.

    £10 a month…. for hours of entertainment…

I pay to support a game I love and have happily played for many years.
If you want to cancel your plus, do. But every gaming community seems to forget that servers, databases, and the human beings that maintain them live in the real world, not a fantasy. Power outages happen, cooling systems blow up, hard drives just die without warning. No company can afford hot swap of everything at all times. If you're going to talk about cloud computing being "always online" you obviously haven't worked in a NOC.(Network Operation Center, the team that's scrambling right now to figure out what happened)

Amen brother, why you don’t have a load of awesomes is beyond me…

The game is rarely down for me when I want to play, and that would be on PC NA, PC EU, and XBox NA. Yeah, there are maintenance times, scheduled and unscheduled, but the game is up for me more than it is not.

Of course, I am not sitting in Europe and don't play much during EU prime time.

So, ESO Plus is not an issue for me, and I pay for it on both PC and XBox.

I dont see how eso being offline takes away eso plus time.

Thats what i was trying to say. As you and td are saying the base game has the tos.

So the complaint is there not eso plus.

Eso plus gives in game perks, crowns and dlc access in effect.

That doesn't get removed if eso itself is offline

Laws are only as good as the ability to enforce said laws exists. Courts being one method. But really we are talking about downtimes that are fractions of currencies. You would have to prove that it's a very chronic issue. Also, most laws account for things such as regularly scheduled maintenance.

    yup, this!

as others have stated, you agree to downtimes and maintenance in the TOS. That game service may be interrupted. If you don't like that, then don't sub.

however if you don't sub, then tbh your opinion on downtime is pretty worthless imo.

We pay 30 days and play for only 25? [snip] is this?

You dont pay for game time, but for things in game... not the same. But I agree it can be frustrating.

Nope, you pay for 30/90/180 days of online acces to full game with all content… And you will never get it…. 🤫🤫🤫

    [edited to remove quote]

Well...thats content. Not play time. You bought the game to get "play time" because its buy2play and the sub is optional. That was the point they were making.

Access to content is not the same as access to actually playing the game. Not only that there are other ways of acquiring the content apart from the crafting bag which is the only real content for any ESO+ member so im not really sure how all that translates into game time.

Why would I punish myself and not have ESO+ and all the great perks it provides just because the game was unexpectedly down?

ESO is not down most of the time and we do not lose 5 days of playtime every 30 days. The server crashes this week were not typical.

I mean it's quite simple for me, I like ESO better than the competition despite its flaws, and ESO+ is great value and QoL. Outages happen in every online game, and I recall nothing severe even in the last year. It sure is annoying during events and if it results in ticket losses, but compared to other stuff that's out there, yeah. Lost four tickets to outages, but not any sleep over it. PC/EU does seem treated unfairly though. I mean even AGS adjusted their patch times due to popular outrage/demand, and NW is a dumpster fire.

I pay for ESO+ annually so I do save quite a bit. I could play without the craft bag but having it is a big plus for me. IMO I have been getting a good value for what I have been paying. BTW, at one time we did have a mandatory sub in order to play. I paid for that at the time too. The fact is that I have been enjoying it since I started in closed beta. I have taken a few 3-6 month breaks now and again. I intend to keep laying until my expiration date arrives.

This is some flawed logic. Do you want them to stop updating the game? Take a min and get some air, go see a movie or find a girl friend.

We do pay them to maintain the game. Even then it is rare maintenance takes an entire day though sometimes it does take a big part of one.

In simple terms. I pay for ESO+ to support the game.

    Yes it has faults.
    Yes, it is beautiful.
No, I have not experienced crashes or other events that make the game unplayable. In other words...
I feel the game is stable.
    I love the craft bag.

Above all, I want to support a game I love. I feel the designers, story writers, community liaisons all work together to create an experience for the players.

Basically, thank you and yes, I feel paying for ESO+ is worth it.

Not sure why I expected a poll when I read the title. I've subbed for almost 5.5 years for...reasons. The servers are rarely down, and when they're down for planned maintenance, I'm glad that maintenance is occurring. ZOS doesn't spend money on maintenance 'cause they want to throw away money. It's necessary. I especially appreciate when there's patch maintenance. Servers have to be offline for 11 hours to put armory system in place right as I would normally start my ESO play for the night? That's fine, and thank you for implementing armory system.

Because you signed a contract that included information about maintenance and other downtime.

Because we do not live in a magical world where video games fix and maintain themselves.

Well I wouldn't say it too loud as Skyrim aafter release was one of the worst developed game in the world, fixed for free by the game community and it took countless effort and time and it was absoluely free for the company.

OK, so the elephant in the room that everyone is dancing around is this. You do pay for 30/60/90 days of ESO+, sooo...., downtime should be factored into how long your 30/60/90 days of ESO+ lasts. Period. End of Story. If, during your 30/60/90 days of ESO+, the game is down for 2.9 days of maintenance, the subscription elapsed date should reflect this downtime. I do believe this is what the OP is referring to. You indeed are not paying for 24/7 play time, but you are paying for a period of time during which the ESO+ should be in effect and downtime should, indeed, be factored in to your subscription length. PERIOD. Also, during the weeks of "Free ESO+", that time should also be factored into the elapsed periods of paying ESO+ customers extending their sub by one week as well, since the game is free for everyone who takes the free time, and they aren't given the option of extending their sub by that extra week. This is why I do not subscribe. It doesn't work as it should.

For those unsure how it works.

You sign up to membership period not a play period.

You get all the perks continuously in that period and some remain after the period ends.

You get the included crowns upfront.

So for me this is a good deal for us.

Keep complaining and moaning and they will change the terms to keep you moaners happy.

There Is eso plus free events the same as free to play events.

These do not give you the same benefits as paid for base game, chapters or eso plus so are not comparable in that sense.

Eso plus is optional. Eso was pay to play on a subscription basis originally. But was changed for the better.

So there is no elephant in the room.

I feel like I'm paying for the benefits of ESO+ during the time I'm playing during a set calendar period. If, during that 30/90/etc. time period, I'm unable to play because the servers are down for maintenance, I don't feel I've lost anything. When I am able to play, ESO+ improves the quality of life in game (craft bag alone does that). I understand your position; it's just not a position I share.

Funny, I see the elephant and so do the rest of the people commenting that it doesn't work for them. For us, especially those of us who have dropped, canceled or never signed up for ESO+, it's not a good deal if they offer a service for a defined period of time and then do not honor that period of time for the service.

You can deny it and post links to guides all you like. It doesn't change the fact that the period of time is described, quite clearly as 30/60/90 days that you are paying for. If during that 30/60/90-day period you are not receiving what you paid for, you're being gypped. If during that period of time the service is offered for free for a length of time, your paid period should be either paused during that free period or extended properly afterwards.

I'm not moaning, or complaining, I'm just not paying. It's that simple. I will continue to buy the chapters I like and the DLC I like. Anything else, is just not value for my money. You're entitled to feel differently and behave differently, as are those of us who are not satisfied with the current terms of their ESO+ membership periods.

I'm very disappointed with eso+ bonuses
ESO+ bonuses are worth more than what you're paying for. Let me guess, you won't be happy until you get all the crown crate items for free [snip]

But eso plus isnt a service as such. Its an optional extra. And as i have said previously its always present during your subscription.

The base game however may not be. But they are two different things.

I pay for a food delivery plus say. Monthly fee. Its always there but i if the restaurant isnt open then i should get a refund in your opinion. Even though when i took the optional extra subscription i knew the restaurant had closed times. But if the closed times fall out of the regular times that makes the plus service unavailable in my subscription period this i need a refund?

How do you work out a refund? Whos responsible? Whos paying this person to run the refund service?

I dont see what during the 30 day period we are not getting ?

You still get extra storage, have already had the crowns etc..

So then the refund for the not received items is very complex no?

Same with the free play stuff. You dint get all of the perks from buying plus. So whats the equivalent refund there?

Its not a like for like scenario.

You technically are moaning too. It doesnt work for you. Fine. Dont subscribe. But you cant then moan about it in the same sense. I would say your opinion is the minority. The majority vote with their money ie subscribing still.
