We're talking about cosmetics with the crates, @Scion_of_Yggdrasil ... not Pay-to-Win items that improve your combat prowess and put you ahead of other players.
In other words, your view of the "latest content" is purely optional since it's cosmetics.
As mentioned above, if ZOS were to start distributing free crates in earnest, no one would buy them because players have accumulated the gems they need to buy what they want.

Is there a secret handshake and code word used to get this content any other way...? Therefore, since you are so concerned with semantics, I can rephrase in a way you can't misinterpret: you have NO OPTION other than to gamble, to obtain the new content, if you so desire (just because you might not want to, doesn't mean the majority of us that do, don't).
