Agreed.

The way I always imagine this working out if a player ever took it to the courts is that the player would claim that the game had at all material times been "literally unplayable" at which point ZOS would produce their data log showing the thousands of hours the player had played the game, as well as the number of players logged in at those times, and the court would then throw the case out as frivolous and award ZOS their costs against the player.
