I agree that the performance is a serious problem but Zos has made a statement. That statement is in the form of an updated performance improvement plan.
Granted, they can address why the previous stages of the plan do not seem to have the positive effect we would expect but the fact is Zos did make a statement.

Out of those 3 million players ESO has a pretty good idea of how many bought the next chapter and a pretty good idea of the current performance.
If you expect developers to give you a phone call every time you complain you will always be disappointed.

A business never really worries about folks who complain unless it really is a coordinated campaign that will hurt reputation.
What they do worry about (in my experience) is those that don't complain and just don't use your product/services anymore.
Unless its addressed quickly (and im sure they are monitoring it) things can go down hill fast.

Problem is that most overland players/questers will probably just ignore it and move on, writing it off as a temporary glitch. I think we really need lots of F1 bug reports every time this is experienced - would be harder to ignore, maybe, if there's an overwhelming surge of in-game bug reports about these performance issues?
In my experience the performance issue is not as big of a deal as these forums make it. Sure there are bumps here and there and I dont pvp so cant talk for that but in my experience (I'd say more fall in my experience than hardcore pvpers or the forum complainers) it isnt that bad and they wont see an exodus of players.

The moderators have removed multiple conspiracy theory post in a bunch of other threads. It's a video game man there are no conspiracies against you or the players. The majority of players are out playing the game and obviously enjoying it as we have seen a major increase in players.
Some of you guys just need to take a break and as the lockdowns loosen up a bit head outside for some fresh air.
Sure there are some issues but nothing close to the conspiracy you are describing here and let me know when you file your lawsuit or complaint I will certainly be watching it with amusement.

This current lag is New Issues + old Issues colliding, I doubt the next chapter will fix, they'll just spin up more game servers / hardware to support the first week then drop them.

Probably, but it's also true that the test environments don't give them the kind of load they need to test things. I'd be surprised if anything close to 1/10th of the game's population goes on the test server, I know I don't. The best they can do is compare before/after there and hope...

Maybe they are tired of the vocal minority screaming at the sky nonstop. Instead of bringing out your pitchforks, lawsuit threats and threatening to quit everytime you have a lag spike maybe the negative over the top complainers could try starting discussions I don't know in a more civil tone?
Very few of the 20 or 30 major complainers are going to quit most will be buying the next chapter it's all show and guess what they have all that information at their finger tips.

And yes, I do agree. Our PTS doesn't actually test server load. They need to hold events which give rewards. And truthfully WHO CARES for console players, we're server testing for them to make sure they don't get a bad server patch. At least theres an even to help PC push for changes and show what real server load would look like. Steam shows a giant decline this month right before a chapter, thats bad news usually. Chapter releases have an increase usually.
Also, I know about ~50 people that usually buy chapters who did not buy it yet, including myself. and I am a whale myself. I see no reason to support them or whale out on items I want right now due to how bad the game is.
3/5 performance patches in and 99.99% sure this is the worst it has been since ALPHA.
