No, this just opens the door for trolling and exploiting.
Point 1: There is a Dark Brotherhood quest that requires you to kill several NPCs in Kvatch. There is a lot of scope for 'trolls' to wander or wait around Kvatch waiting for players to perform their quest kills and then kill the quester.
Point 2. My wife and I can go somewhere quiet, I will kill NPCs and my wife can kill my character, collect the bounty and split it two ways.
So no, your idea which sounds fun, just won't work as it stands.

Tbh, just copy from WoW - if player enables "world PVP" mode he receives +30% increased rewards for everything in overland but can be free killed by members of other alliances (which have PVP mode enabled). If PVP mode is enabled make all guards of opposing alliances hostile by default. PVP mode can be disabled/enabled only while being in alliance capital building.
Idk why this was not implemented yet, it will make game way more fun and lively. And those who don't want to participate are completely free from it if they don't turn on World PVP.

Have to ask why you want to make this game more like other similar games? Why not go play the other game?
For me, this would be then end of my ESO addiction. If i want pvp, I go to Cyrodiil. Overland i want to chose if i play with others or not. Its bad enough dealing with unkillable guard npcs - but other players? Especially ones that have a tendency to be very childish & petty? No. Gods, no.
And one more problem - you know how bad the lag / dcs are in Cyrodiil at the moment? And you want this for the entire game?!! 🤣🤣
