Wouldn't that be a tad hypocritical of ZOS to take a judgemental stance on gambling? Since they do sell crown crates which are a form of gambling.
I like your idea about the fee though, that way the pot for the winner could be larger and if the organizer did run off with the gold then each individual would of only lost a small amount of gold as opposed to a large bet between 2 duelers.

Imo betting of in-game gold can't be considered gambling. As for crown crates, they are pure blooded slot machine, I agree there is no point to argue on this obvious fact.
