Lets not pretend here, there is a huge leap from a minor being exposed to those things, and a minor being exposed to actual people virtually soliciting them for sexual relations, whether its for gold in game or money outside game. It's harmful to minors. Hormone fueled 13-16 yr olds empowered by anonymity are victims if they engage in behavior, virtually or not.
Again, minors aren't legally allowed to play this game. They are violating the ToS when they install this game and agree to the ToS under false pretenses, which is a bannable offense.
There is no way to know the age of the person behind the keyboard. You simply cannot refute the black and white nature of a minor not being legally able to consent, and that the parents and Zos both have responsibility.

It is, but that does not prevent minors from being in the game. It is a much lesser offense to have a minor in the game, than it is to have the minor get caught up in what this thread is about.
There is a guard in Belkarth that, if he catches you stealing or with a minor bounty and you pay the bounty, he propositions you. Surpised the heck out of me but it was funny.

Also, yes its an M rated game and its clearly marked as such. And yes it is up to the parents to be parents and decide if their child is mature enough to handle the content. I think there is still some legality even so if a minor (under 18 as far as the U.S. is concerned) is exposed to it, knowingly or not.

Thing is, anything vocal isn't even close to what you describe.
Also, it's not about vocal prostitution, it's about the means in which would be required to monitor such activities. How would ZoS go about monitoring private chats etc?
ZoS can monitor anything that is typed in any game chat whether its zone, group, say or tell. Its in the logs.
People have been banned from the game because of things they said to other people in private chat in the game.

This is true. This is also how they sometimes catch gold farmers, I imagine - if someone's regularly sending large amounts of gold to random strangers, I can definitely see them looking into it. However, I think there's a significant difference between "this is a thing they can do" and "this is a thing they should be regularly doing to ensure that children who already aren't supposed to be here aren't being exposed to adult content."
Though what's being described IS tactless and distasteful, I'll give the OP that. I just think that ignoring and moving on is probably the better option. Especially since it's really hard to verify age, and banning for sexual content in private is a whole different can of worms. And, honestly, unfair to people who are into ERP - not my cuppa by any means, but I hold nothing against them. Given the assumption that they're consenting adults, I think they should be able to ERP in private to their heart's content without worrying about a ban from an overzealous GM reading their mail/whispers/etc.
idk about this issue but from what OP wrote seems like prostitution RP that include in game coin payment as well. Not sure how to feel about that, but can't remember if I have seen anything about it in TOS.

Its not a game for minors, its not advertised to minors, its not rated for minors. It is not ZOS's fault or the player bases fault for a parent allowing a minor to play this game.
So since the parents are to be found at fault, how can they, since they had so little control of their child while online? Your own argument collapses on itself here. You say Zos isn't at fault for allowing this to happen, but legally in the real world we live in today, both parties could be charged on different charges. If you feel weirded out about the idea of maybe you ERP'd with children, that's your own path to figure out. The community this game touts is accepting, caring at times, and we should support protecting kids. Looking at this from a legal standpoint it is very ugly for all involved.
