Well, if you're referring to other games - most open world pvp situations are disabled in major areas or have guards to protect players or attack people who target those in cities. Any other way just doesn't make sense unless you're going to be griefing for fun.

I don't mind protected areas and the justice system is already in place to add you as a murderer or if you assault someone. So attack a player in town and the guards will be on you.

An incentive to duel in certain areas would be nice at the least. Like the ability to bet on duels in hammerdeath arena and/or rewards for winning duels against X different opponents there every day. Like a constant event or one that exists only during the weekend every week. Such things wouldn't remove people from dueling wherever they feel like but would incentivise them to go somewhere else

It's funny you added missions to your list, because this morning, while in the middle of a quest, I had some person trying to duel me. My auto decline must have offended him because he started tossing buckets of water on my character while I was doing the quest. Annoying.

Those games tend to have specific servers separating you out though. Most normal players, especially new players, do not like pvp, let alone open world pvp everywhere. You're going to a very very niche group.
And fyi, I played my first MMO in the game Tibia which had a brutally hardcore open world pvp system, so I'm not completely biased against it. I just feel it needs to be a choice since I am also getting older and slower and want to relax on my games, not be:
