Just be more alert, or use detection. Problem solved. Everyone here saying no without giving reasons. It'd be easy to counter if you make it so.

Countering isn't the issue. It's that it would open up a one-shot option to any build at all with no cost or drawbacks, with the possible exception of having to run medium and/or vampire for better stealth. That's simply unbalanced. Currently it's possible to build for extremely high damage ganking only if you give up the possibility of other playstyles. That's as it should be. Your idea is all get and no give.
I've totally felt like Blade of Woe should be allowed in PvP for a long time. Can't really see why it shouldn't be allowed. Perhaps make it allowed in PvP for the Dark Brotherhood anniversary event, just to test it. Of course it should only work on players who aren't hidden and you've got to be hidden. Would be great for handling people on siege weapons. I'd totes love to see it. The Sithis' Touch is pretty much useless but would be useful if Blade of Woe assassinations were allowed in PvP.
