From what I've seen from previous situations, and as stated by them in emails, ZOS disciplines the account, not the player. I know a couple of players who've been permabanned (both for different reasons) and have bought new accounts.

In one instance Zenimax staff told the player they were welcome to buy another account and start over. It seems that you're welcome to as long as you keep your nose clean and you've learnt your lesson.

In the case of players recently permabanned for the use of third party tools to hack the game - one of who had already been permabanned for similar offenses previously - I'd think it would be completely at ZOS's discretion. With a change of details it wouldn't be hard to have plausible deniability.
