I know a few people who have gotten banned and had it overturned on appeal. None of them are popular, "famous" or even infamous streamers. I would caution people to not be so quick to yell "special treatment" just because a decision was reversed after consideration.

I agree. If they want to make it right for everyone then they should unban everyone who was previously caught account sharing and give them a warning that there will be no more exceptions if it happens again.

I apologize for the ignorance but who's this Sypher everyone is talking about?

I've found a banana with a name like this today whom even swarmed by 5 players and without any apparent healing (e.g. Vigor or BoL animations) his health bar didn't drop even 1%

I asked in guild and someone said said that was obvious this player would be "immortal" (not exactly these words) but like every obscure actions nobody explained but, are they the same person?

What about Germantrocity? you guys banned him over something far more frivolous then this, and refused every appeal to have his account re-instated....i guess this streamers money and time is more valuable then his? If anything Germ was treated unfairly while you turned around and bent over backwards for this guy....

Or how about how you folks unfairly treated Columba who was a pillar of the Dc community for actually wanting the game fixed, and you rewarded him with a ban...he was totally treated unfairly

So... this thread got re-opened? Does this mean that it is OK to ask questions about what is and isn't allowed under the Terms of Service and the rationale behind them? Because that's what was going on here when the thread got locked...

I mean the question clearly came up because of a specific disciplinary decision, but the discussion here wasn't ever about that specific disciplinary decision. The discussion here was all about clarifying what is and isn't allowed, and why. And the thread got locked for it.

Can a mod please clarify whether it's OK to ask questions about what is and isn't allowed under the ToS?

@ZOS_JessicaFolsom or @ZOS_GregoryV can you maybe chime in? Because right now I have no idea whether we're allowed to ask about the ToS at all...

Streamer Privledge? Not really. Another player who isn't a streamer got unbanned within the same time frame and was under the same circumstances.

CHanging the network adapter

The computer is running MAC address cloning software.

Any software that adds a virtual network adapter can change it too.

Please understand I have no issue with you and I'm glad you and the other person you mentioned got you accounts back.

What I have issue with is how ZOS handled this. I named two of quite a few people I know who were perma banned for far less that never got their accounts back. It's simply unfair.

I want you to know my frustrations are not levied at you, they are levied at ZOS and how this appears...zone chat in a few zones this evening were very upset about how this was handled and appearances are everything...there needs to be uniformity to ensure folks are treated equally, most of the people I mentioned were not given 2nd chances and that's simply not right. I know this has nothing to do with you, but it don't make things look good to the average player, especially when a former guilty was perma banned for transferring 200k gold from one of his toons to another with his bank and never got his account back...it's simply not fair and such injustices shouldn't be tolerated. I'm ok with you getting a second chance, but there are many others who derserves one that was never given...

3) the dude -sort of- advertising the game
for me as a player, he just helped me, made guides for me and so on to get me along with eso and play it
for ZOS as a company, he helped by alot of things

I was defending Sypher all night over the perma ban. Maybe a 24 hour ban with a warning but a perma ban? The problem here is it would have been better for ZOS to just let it go after they made their decision to reactivate his account. Instead they admitted to special treatment and now are hearing from the player base. They deserve anything negative that comes from this.

P.S. Glad you got your account back Sypher. A perma ban for that when there is massive exploiting going on right now didnt sit well with many of us.

They see a system that appears corrupt in handing out uneven enforcements of arbitrary terms that are heavy handed to some and slaps on the wrists to others for infered reasons and this is just simply a bad image to allow to transpire.

As has been said Sypher is not being treated specially. Anyone deserving of it can be given a second chance if the offense isn't too serious for their circumstances. Yes the way Zenimax said it makes it sound suspect but he said it himself he went through the proper procedures and everything. If he gets caught doing it again he would not get another chance.

Yep. And it appears that you get special treatment if you're putting money into the hands of the content providers, to the point you forgo ban decisions. Bad move. @Sypher knows he should be banned, but is being safeguarded and his hand being held by the staff at ZO$. Gotta love when the game of "Playing Favorites" gets played even on a business and corporate level, as shown with ZO$.

It's to the point people in area chat on PS4 are snapping right now, and cussing up a storm. I'd record it, and post it via YouTube video, but I don't want to get banned for posting explicit content. But yeah, people are certainly unhappy about this special treatment. And are very vocal about it right now. The hate toward streamers and ZO$ is in rare form this evening.

If you break any law is it fair a cop lets you off but not the next person? It's the same thing. Things need to be uniform and folks treated exactly the same. I would lean more towards unbanning those that didn't get second chances rather then banning you. I prefer positive outcomes.

What you have done honestly should have no bearing on the decision in this case. Using all those things you have done for ZOS with advertising and making them money as influencing the outcome of their decision is a clear conflict of interest.

People get banned and then given second chances like every week, all ZOS did was explain why they were given a chance in this particular instance. Normally when people are given second chances nobody bats an eye, but since it's a high-profile instance everybody and their mom (Hi mom!) has heard about it, so of course they're going to come forward with their rationale. This isn't special treatment, it's just the only time so many people felt the need to scrutinize.

So they made a one-time exception to those involved due to the years of contribution to ESO huh? Well I will expect that I be given a second chance in case I do something wrong because I have been a subscriber since launch and I have bought plenty of mounts and costumes. I have put hundreds of dollars into the game so I would say that's enough contribution to get at least 3 "get out of jail free" cards right?

It wasn't special treatment. I honestly don't blame a company for giving a long-time player with good standing a second chance because it's how you properly show customer appreciation. I know companies that don't do such a thing. If the offense was more serious perhaps he would've been permabanned but for account sharing? He admitted his wrongdoing, doesn't plan to do it again, so he has a second yet final chance. He will no doubt be permabanned if he does it again.

Generally speaking, it is acceptable to ask questions about the TOS and the forum rules. However, the query can't be tied explicitly or implicitly to a specific incident. This thread was locked for the latter, and we were also getting a large number of threads explicitly discussing the ban at the time.
