So it's just a case of how the individual is actually thinking about it themselves, so if they thought of it as, it actually is, which is a group of pixels moving up and down they can't take offense.

And yet you've still completely missed the point. Your "solution" will never work when you have a large group of people gathered in an area for an event. And the larger point is that no one should have to resort to that. The person who is in the wrong, the troll, should be the one removed and sanctioned. In lieu of that, a visual as well as chat /ignore feature would take care of the problem with no further requirement from ZoS to enforce the terms of their own TOS.

We have a sport similar too American Football, but a lot more physical in Europe called Rugby, one of the best teams in the world called the All Blacks start each match with the "Haka" this is a display which is meant to intimidate. This is a part of a physical game, the idea with any physical is to make your opposition scared, or to enrage them into mistakes, it's part of being competitive.
Whilst for some this is offensive, I would imagine most would take it with a pinch of salt.
This is the issue you are missing, just because one person finds something offensive doesn't mean something should be banned. I find many things offensive and repugent, but I don't believe I have the right to have it removed because this is an opinion I have.

2. This is impractical when you have an event going on with several people. 15+ people should not have to flee to wayshrines and move their event elsewhere because 3 whankpuffins show up and decide to ruin it for everyone.

As already mentioned, proving that someone is breaking code of conduct is Subjective. Someone spaming a skill in an area where you happen to be is not breaking this code. You may feel they are doing this to grief you, whereas they may just be testing their skills, seeing how long their resources last. (i'm not saying this is whats happening, I quite believe there are people who would find it amusing to interupt your gathering.)
1. I agree that you shouldn't have to flee someone Harassing you, however I also believe there should always be a proper investigation before any individual is banned or removed. This means we can never remove someone straight away!
This is an MMO which when there is enough people in one area there will be more than one instance, so in these cases it may be possible to put you in a different instance to them. Sadly I believe the population is no longer large enough for there to be multiple instances, so for your request, to be fair you should then be put in an instance where there is no one else!

If we cannot, for some reason, have a visual ignore feature, I would be satisfied with being able to choose an instance. However for this to reasonably work what would need to happen is that someone chooses a location and then has the option to choose something like Enter Group Instance and then only those people in the group could enter the instance. However, off the top of my head, I cannot recall the max number of people you can have in an instance. It would literally need to NOT have a limit for this to be workable. This would then make it so that RP events could be scheduled and held privately so that they could NOT be interrupted. This, in conjunction with a Change Instance feature so that anyone could, at any time, "leave" where they are being harassed while not ACTUALLY leaving the area at all would somewhat solve the problem. You've obviously never been at an RP event being griefed by multiple players. They CAN and DO make it impossible to ignore them and carry on with what you are doing. So it's still clear to me that you don't really understand the problem, and apparently don't want to.

At all times users will refrain from attacking Age, Race, Disability, Sexual Orientation, National Origin, Pregnancy, Gender or any other protected category under Federal or Maryland State law.
So as you clearly stated, the All Blacks "Haka" is intended to threaten, distress, and cause discomfort in others. If they were playing ESO, they would be violating the code of conduct (COC). ESO is NOT a professional sport. The COC are quite clear and are all that matters, not our beliefs.
If you do something that distresses or causes discomfort in another player, it IS against the COC. Specifically, the primary purpose of tee bagging is to embarrass another player. Please don't bother to claim it is humorous. That is NOT its purpose.
No one is saying everyone who tee bags should be banned; but EVERYONE should recognize that tee bagging IS against the COC.
The particular purpose of this discussion is looking for better solutions to COC violations than direct ESO involvement (i.e. banning).

They are not going to ban anyone for spamming abilities.
If thats the case, then guess what? i want a guy banned who healed me once in Grathwood. Also, this one guy followed me around in the sewers for a bit when I didnt want him there. And dont forget the time I was in Auridon and there was someone dancing in their undies on a wall! BAN THEM ALL!!!!
