I am saying that he isn't doing anything "wrong" in terms of Zenimax rules.
He is killing something that is spawning, he has no control over that. Its not like he is doing something particular to spawn it that fast, it just is.
There is a difference from using a system that is working strangely vs actively exploiting a system to have it do what was not intended.

It is a safe bet that killing an instantly respawning enemy over and over is not intended. Thus doing so constitutes exploiting an unintended game behavior.

as long as you're not using bot to do it like this guy
he's constantly using exactly same attacks in exactly same amount of time
...and that's pretty hard to achieve by actually controlling character yourself

Yea, but the people seeing the picture and forum post don't have to know that.
Step 1) Take picture of someone doing some random task, doesn't matter what really
Step 2) Claim they were exploiting in doing it
Step 3) ...
Step 4) Profit
We know nothing of this guy, only that he's killed the same NPC at least 5 times. Everything else is what you, random forum stranger #832834958m has told us. For all we know, he could have been just screwing around for a few minutes, killed the same NPC a few times, and gone on his way.
This is why "name and shame" is bad, and why you will likely see this thread locked. Because the only story we can see, is the one you tell us.
The useful thing about the report tool is that ZOS has logs, and will see exactly what he was doing and for how long. They can handle this, all we can do is debate over whether we believe this guy was exploiting or not.
Posts like this do more harm to the community than good in my opinion.
What will essentially happen now is people that didn't know about this bug are now going to exploit it.
It is better to report in-game.

But to block this topic someone needs to READ it, then will check for existing reports (and will find at least 3), so goal will be achieved and problem will be noticed
