The stacking bug is when you kill lots of undead and evil hunter lasts for ever, the bug doesn't increase its proc rate or its damage.
What happens is the player will get multiple Hunter Buffs all active at once. They will all trigger at once and instantly kill enemies.
The time, damage, and procs all stack. We know this, it has been reported, ZOS knows it, this exploit's days are numbered.

Yes, because it's players who take the responsibility for the skills being bugged as much as you can prove someone is using it "knowingly" or not.
