You cant commit a crime with them cuz it wont let you and they are "aware" of you.

But yeah this is ridiculous, I don't know why NPCs don't have their awareness turned off when in a bed or something. Not sure if the coding is too hard or what but you'd think if they can code NPCs to be unaware when you're behind them, they could code them to be unaware when in a bed.
