If I recall correctly from the ESO live Q&A, there will be abilities that you can put skill points into that go along with the Justice System. So it is conceivable that an intimidate or persuade could be a part of that.
The question that now comes to mind is, How would an enforcer actually communicate with a criminal? Perhaps something could be integrated into the chat window where an enforcer somehow receives a "Wanted list" and is able to whisper to that player, "I know what you have done, now Fess up and give me a cut of the take, or I will mow you Down!" To take the idea a bit further, perhaps there is an incentive for the enforcer to persuade the criminal to give up peacefully (xp or gold), so there isn't just an immediate resort to violence. Of course, if the criminal refuses then anything goes!

I mean, we all know that the PvP elements of Justice System will in a future Update, but as I've understood there will be PvE quests available as well.
Maybe Enforcers will be able, for the time being, to pick up Bounty quests targeting NPC's (I'm thinking a similar thing to the PvE-quest hubs in Cyrodiil).
