Nope that alibi won't wash, the question is one of POLICY not specific cases.

The fact they're not prepared to make a clear statement about the TOS is itself all the answer one needs: they're not serious about ridding the game of RMT since they're not taking any action against the root cause.

They are probably relying on RMT'ers to sub as many accounts as possible because it is a source of income.

If they lose me, they lose one account.

Not true, because "gasfga" is using stolen credit card details, so all his payments will get reversed
