Theft of services?
Unless I'm mistaken isn't it theft of services if someone pays for a service and is then denied that service?

otomodachi✭✭✭To be serious for a second, probably not. Shouldn't get legal advice in a forum, but...
The ToS talks about downtime being something you just have to accept, for basically whatever reason. This'd cover that.
Second, before anything like this becomes criminal, you have to make what is called a "fair attempt" to settle things amicably with the merchant.
US law only of course.
