But as far as I can see the only way to stop them is to opt out of all marketing emails related to the game, which I'd rather not do. If that's the only option I might opt-out and rely on getting my news elsewhere but if there's a way to stop just these ones that would be preferable.

They shouldn't need a database for that, the game itself can track it. That's how it knows how many days of the login rewards you're eligable for and how ZOS have run promotions in the past where you get a reward if you log in during a given period.
If the email was sent once a month (maybe to coincide with each new set of login rewards) they could just check which accounts have logged in and send it only to those who haven't been online in the past month.
