    and you signed it lol

Nobody signed anything, they clicked agree. A TOS barely has any legal standing as is, especially one as vague and ambiguous as ZOS's.

We're welcome to complain and critic the issues, just as they're welcome to not doing anything as per the ToS.

Although TBH I don't think they're going to just ignore issues due to a ToS line.

This. There is nothing in that ToS OP posted that says we are not permitted to comment on the performance of the game. It would be a little absurd to tell your customers to shut up so they tend to not put that in the ToS.

OP probably thinks its okay for police in the USA to kill homeless and minorities too because they had it coming.

That might be going a bit too far, I highly doubt they would be ok with that.

No. They were going to ignore the issues anyway. This just allows them to say, "look guy, you agreed to this garbage service, so stfu and give us more money."
I'll give you 100k gold if they ever say that.

..if someone is recorded saying that, off-site, and outside the range of ears of someone who will fire them.
For a moment, nothing happened. Then, after a second or so, nothing continued to happen. - Douglas Adams

It is a rare mind indeed that can render the hitherto non-existent blindingly obvious. The cry 'I could have thought of that' is a very popular and misleading one, for the fact is that they didn't, and a very significant and revealing fact it is too. - Douglas Adams

Oh well, that is as if your car company had a TOS saying "NO WARRANTY IS GIVEN ABOUT THE QUALITY, FUNCTIONALITY, AVAILABILITY OR PERFORMANCE OF THE CAR YOU HAVE BOUGHT/RENT. THIS FIRM DOES NOT ASSUME LIABILITY FOR ANY INABILITY BY YOU TO ACCESS OR USE YOUR CAR"...

That would be worth very, very less than the paper on which it would be written, lol...

Where this argument loses it's steam is at the bank account which is something I expect Zos is fairly aware off and why the comment is merely an attempt at drama.

Thanks op we gotta shut these haters down. You all are playing a beautiful world, sometimes in 4k but hey they are trying. If there are issues its user issues.

What do you expect from them it's only been 5 years. I for a fact love the sims 5. I get to make my house and invite guest over. Also items for my house in the crown store all the time. You guys need to just relax and get a house, you will love it.

NO WARRANTY IS GIVEN ABOUT THE QUALITY, FUNCTIONALITY, AVAILABILITY OR PERFORMANCE OF THE SERVICES. ZENIMAX DOES NOT ASSUME LIABILITY FOR ANY INABILITY BY YOU TO ACCESS OR USE ANY SERVICES. ZENIMAX DOES NOT GUARANTEE THAT YOU WILL BE ABLE TO ACCESS OR USE SERVICES AT TIMES OR LOCATIONS OF YOUR CHOOSING, OR THAT ZENIMAX WILL HAVE ADEQUATE CAPACITY FOR SERVICES AS A WHOLE OR IN ANY SPECIFIC GEOGRAPHIC AREA.

Include tos (above in bold) in a letter with concerns to your state attorney's office, ftc, state politicians, etc..nothing may come of it, who knows.

Voicing concerns here will accomplish nothing.

Personally I think the PVP lag has gotten better for me over the years. It's so good now that my toon attacks even before I press any buttons. (Sarcasm).

    LMAO!

The best sarcastic statement I've ever read on these forums. :)

THANK YOU! I told you guys, you pay for access to their "Service". If there are circumstances outside their IMMEDIATE control that effect the "quality" of said service, they are not liable. That has been the case with pretty much any MMORPG since like...EQ1 days.

... that's not how product sales works.

    No, that's how "services" works.

Yes, I read that as well. If the game is unplayable it's time to cancel subs, uninstall and move on. Why pay and try to play an unplayable game?

For me I have no issues with playing the game. Latency is always 80 to 120 ms and no issues in Cyrodil either (still get around 30 FPS) in large scale warfare.

ZOS doesn't need anyone standing up for them when it come to providing a substandard product that we have all paid for. They have two whole departems, legal and marketing that we have also financed, to do that for them. So please players, stand up for yourselves and what you want first. Thanks.

Bold words. So why are you still financing them? If you are you are specifically saying you like it like this.

I am not advocating a boycott or anything. but when speaking this boldly I expect the person is no longer a sub, buying DLCs or chapters, nor buying crowns.

It has more standing than these words. Unless you choose to take them to court it is literally meaningless to suggest the ToS barely has any legal standing. It is just blowing smoke.

ToS probably has more meaning when it can be shown someone disregards them accepting them as you have. Blowing smoke has probably harmed legal cases before.

BTW, I am not defending Zos. I think MattF is a great example of someone with poor management skills and the biggest part of the problem
