Not bannable as far as I know - but the community (friend and foe) will hate you for it (I've already started!).

I didn't realise anyone was still bothered enough about the campaign to actually not play and just sit there watching stuff....!!

There's no "grand strategy" taking place in cyrodiil that requires spying. It's just about large groups of players smashing into eachother until the side with more people eventually takes the map. Spying is pointless.

The spy was a part of real battles, why not in a gaming equivalent?

Because there is absolutely nothing you can do to stop them.
It's not like you can shoot them to make sure they don't do it again.

I mean it's not like their character is in stealth watching them, or in disguise, pretending to be with the opposition, and can be uncovered. Their character really is, in game terms, with the opposition, so you simply can't touch them.

Quoted for truth. Not having Faction locked campaigns is the central vertex in all of these issues and the second biggest reason no hardcore pvp guild takes this game serious. The first being the skill server failures.

Spying and running Scrolls as acts themselves are not banable, but as others have stated, gap closing into a keep to obtain a scroll is. We have a plague on PS4 Na in vivec right now, the top 2 leader board dc players are taking all the Scrolls by letting eachother ambush into keeps. Check this video, this right here needs to be dealt with.
This is the aids in being able to jump factions at will, this guy took every scroll through glitching his friends into keeps and then crowned Emp the same way
