I feel it should be more like:
2 items: +50 Ping
3 items: when 3 or more enemy players are somewhat near you, your FPS will be decreased by 50%.
4 items: +50 Ping
5 items: when you or anyone around you do(es) anything, your game has a 10% chance to proc the freeze, disconnect, or crash status effect. This effect can occur once every 5 minutes. Additionally, when you do absolutely nothing, you will have a 6% chance to proc an unusually long loading screen popping up out of nowhere. This effect can occur once every 10 seconds.

As initially noted by Beruge, their invisibility breaks the second they attack you and detect pots can be very effective against players who are overly focused on remaining cloaked.
Every player has access to invisibility via invisibility pots. My personal preference is the one that also increases your movement speed.
More drastic counters to invisibility are skills like mage light, expert hunter, and revealing flare, which some might not be willing to slot. Of course, you could also make use of regular AoE abilities. If you know the approximate location of the invisible player you could drop an AoE ability in that direction and if the player is slow/inexperienced you can keep them from cloaking with this tactic.
When a nightblade attacks you from stealth, takes you down to 15% health and uses resource draining potions, peoples first instint is to use a potion to get their health back. Detect potions sounds nice and can work in group settings but we lose the opportunity to use our fighting potions.
Every other form of detection is like finding a needle in a haystack. On my magplar i kept trying to revive a fallen comrade and people were throwing out revealing flairs to try and find me. Its was an exercise in futility.

This game has more than enough Cloak counters:
True vision pots
Magelight (Mages guild)
Expert Hunter (Fighter guild)
Revealing Flare (Support AvA)
Countless amount of nontarget ground or caster based AOEs
I would gladly give up my cloak for a shield ability
In no game, ever, should a player be able to stand right next to another player and do melee damage while remaining invisible. This is *** ridiculous. We shouldn't have to fight invisible players. Stealth is for being stealthy, not for doing melee damage while standing right next to another player and remaining invisible.
I main nightblades. I have tried it. It's not hard to play. One poison inject is NOT enough to kill but if you read my post, it's the proc sets on top of it and the continuous spam of poison inject. You are wrong, try to play one and you will see its not that easy as you say, and only poison injection is not enough to kill other players or you must be a terrible player.
