Last I read, something like 86% of the companies out there were not ready for gdpr. Nor did they understand in full what they had to do. So in Valve's and many others cases they are going to have to change it so people have an option with the tracking unless they can prove that it is not required by law.

It's not spyware.
It's not active.
You agreed to this non-active-not-spyware when you agreed to the latest privacy terms.
No privacy was compromised via the not-active-not-spyware being not-used by the not-spying-on-you-company.
Therefore there's nothing to sue over.

Yes, by technical definition they may be "spyware", but spyware also implies malicious intent.
