Its new thing for me and I am just curious. Did anyone already sued or planning to sue Zenimax? After all their practice was illegal at least in Europe.

anti spyware its a life and time saver. sueing over a tiny pieace of spyware that you can easily remove just isnt worth the time or the money youll pay out more than youd make

It is being removed on Monday with the next update.

There is nothing actionable even if a lawsuit over this was feasible. Feasible as in no lawyer would touch it as there were no damages incured by a user so nothing to base a case on.

Steam has been using it for over a year, seems like its a lot of hyperbole to call it spyware.

rofl...the idea that because a large company uses it makes it ok is just too funny.

The other one I find funny is that everyone is doing it so it's ok.

It is spyware, by simple definition, it is spying on your non-gaming activity (simply to make someone richer)
the real question is is it malicious or just a plain annoyance that wont make marketing better just waste users bandwidth!

Considering the OP suggested lawsuits and the same product is used by an enormous company and has faced zero repercussions from it, yeah it does make it ok.

Do you mean ok as in not against the law? Or do you mean it's not morally and ethically objectionable?

Law, because thats the only thing that matters. If you dont like it, you can leave, or waste years trying to put it through the courts.

That wasnt because of laws, that was becuase of a HUGE amount of bad press. They were afraid it was gonna hurt the bottom line, not because of lawsuits.

no actually that came up as violating certain laws in different countries. you actually have to do your homework with this as the US has completely different laws than anywhere else.

I thought that may be the case.

As of the implementation of gdpr, it appears that ZOS may have in fact broken the law in the EU. Seeing how a number of people have made complaints through official channels I think it best that the officials handle it.

There are numerous types of spyware, most of which is currently legal. However new laws are forcing transparency and for the default setting to be opt out without the loss of use of the program.

No in the US for sure. We're fighting for even the most basic concept of internet neutrality. Something like this isn't remotely illegal. My suspicion is European law is the only reason they are removing it.

No matter how strict those laws are, I can't imagine it being that big of a deal if it really wasn't active. I'm just guessing but, "We didn't actually do anything and no data was collected" must be a seriously strong defense.

That's a world away from claiming Steam aka Valve is using redshell. Redshell is a service being offered to Steam developers.
