There's no more empire since the political structure has completely disbanded, the armies have either been broken up into bands of roving brigands or have been enslaved by the Daedra, and each of the 3 factions, having retained a degree of cohesion, claims itself to be the legitimate heir to imperial rule. In fact this is a pretty common situation in human history, when a larger kingdom or empire fragments and each faction tries to conquer the others, or even a new faction claiming inheritance from an older entity: ex. the germanic Frankish kingdom claiming inheritance from the Roman Empire, with Charlemagne being crowned Roman Emperor by the Pope in the West, whilst the Byzantines, the Eastern remnant of the same Empire claimed the same; later still the Holly Roman (German) Empire and Russian Empire claimed the inheritance. Even during the Roman empire proper there were long periods of instability, civil war, and a short sucession of emperors propped up, then dethroned, by the Praetorian guards and various legions: there have been as many as 4 successive emperors in short succession after Nero's downfall in 69 AD. So in conclusion you are in fact all playing the Empire, since EP, AD and DC all see themselves as such, and claim legitimacy.
