I wasn't aware of the two different categories. Regardless, maintenance serves to sustain the game, whatever they do during has to be beneficial.

Such as sale of goods act ( goods must be fit for purpose) and the unfair contracts act ( enforcing an agreement on someone that benefits one party unfairly) the list goes on over here, Firms cannot put whatever they want in a terms of service and claim invincibility over it.
Not that they care, but I actually wrote to IGN to ask them what's going on, they took some interest in it and said they would write to Zenimax press office for an answer so we'll see how that goes if anything, only thing worse than a bad sales quarter is bad press.
Also to note on their TOS, more on crown sales and products being non refundable....it's actually illegal in the UK to advertise you don't accept returns or offer refunds...

I certainly hope they fix this game soon! Their servers need to be upgraded to handle the players in Cyrodiil. I am currently downloading WOW to get ready for the new dlc which comes out in August. I would not play wow if eso was fixed, but it is nearly impossible to play eso like it is. I also know many other ex wow players who are considering going back because eso is just plain broken. I play on Xbox.

Or at least you would if Zenimax was based in the UK. Since they are based in the US they are bound by US laws, not the UK's. You can take Zenimax to court if you really want, but it would have to be a US court, since they are a US company, and in a US court, the terms of service will hold up pretty damn well considering they were written by lawyers to prevent little stunts like that in the first place.
Also, freedom of speech only applies to censorship by government. Last time I checked, Zenimax wasn't a government.

A medic is called to clear the dead and dying ZOS employees... “get the cleaners in here with the vacuum ultimate, we have a dust boss to kill!”
Cleaners appear with vacuum ults ready, a war horn sounds and the dust boss is eliminated, the server room is liberated once more!
turuk redclaws smiles and walks off into the distance knowing its only a matter of minutes before the dust boss respawns, can the technicians carry out the maintenance in time and escape with their lives?

only a few seconds left before the dust boss respawns and in a desperate panic a technician find the server off button and shuts them down

Were you around at the time of the subscription model? I get the feeling the game was alot more stable and better supported back then
