The Elder Scrolls IP is simply to valuable to ever let it be in control by anyone other than the owner of the IP.
I know how it sounds, but if people are playing some private ESO server then they are getting an Elder Scrolls fix without paying the owner of the IP, when they could be buying/playing another game with the Elder Scrolls IP that could be making the IP owner money.
In the even of a game closure, it is unlikely you will ever see private servers of this title.
Warcraft is a much larger IP yet people can run private servers just fine, and their income is steady regardless of the presence of private servers. No way would they block that sort of thing on such a weak premise.

Yes they would. Blizzard has already.
Even WB sent a Cease and Desist to a group of players that did nothing more than remake Middle Earth using the Oblivion engine because it is a potential revenue threat and they own the LoTR IP for games.
edit: Oh and don't underestimate the IP for ES. They sold nearly 20 million copies of Skyrim across all platforms. That's a 1 billion dollar revenue maker for Zenimax. Sure Blizzard makes multibillion a year, but 1 billion is something you need to protect.

I'm 24 and I've been gaming for well over a decade. I highly doubt a couple more years down the road will cause me to suddenly put video games on the backburner, but I get your point nevertheless.
