Well, it's a fantasy world and even in Grimm's fairytales you burn witches. It's just a story. That's why I do not consider TESO as violent. It's all fiction.

Bethesda weren't happy with the rating. However, ESRB says it falls under that category for a number of reasons, including "Blood and Gore, Sexual Themes, Use of Alcohol, Violence." Also that it is an online game, and user related content can't always be controlled (ie chat)

They censored The Real Barenziah after Daggerfal. The sexual content in the original version was pretty explicit. Khajiit are exactly like cats in quite interesting ways...
Daggerfall didn't have any issues with nudity in general. It was restricted later, though Morrowind at least had the House of Earthly Delights, which was pretty clear about its purpose. Skyrim had what, a horker's tusk in Haelga's bedroom?
Anyhow, ESO has lots of murder, mutilated bodies, drinking games and references to drugs and sex. So I think the M rating is justified.
