What you're expecting is the mechanics of non-mmo games to be applied to an mmo, yet other non-mmo games don't work like this. In Call of Duty can you share your guns and perks with your brother. In GTA5 can you share your cars or your GTA online money with your brother? In what game can you share the perks of your SPECIFIC save/character with your brother?
As many have said, if you share your ESO account with your brother you will have a solved problem. ZOS has ALREADY removed the game-key requirement for Xbox so you and your brother can share the copy of ESO.
You being uninformed is, quite bluntly, your problem.
This is a really easy fix. Man up and buy a second copy or at least have your brother buy the upgrade for his account.

I'm not judging them. How should they know how a console store works if Bethesda even doesn't (or at least doesn't want)?
I own a console... but I don't share my content with another player. If you're playing on the same console... use the same ESO account. If you're NOT playing on the same console, buy another copy.

The Imperial Edition perks register and lock onto one account, not to the console. This means that if multiple players plan to play on the same system (siblings, roomates, etc.) then only the first one to redeem the key receives the perks. If the others wanted to also receive the perks, they woukd have to re-purchase the Imperial Edition on their own account in the ingame Crown Store.

I can see why they would want to implement such (cheap) methods in managing the Imperial Edition, otherwise people could make multiple accounts on the same system or multiple characters to trade off or sell the Imperial Edition items. However, this isn't the best way to deal with the issue and is actually quite unfair and deceitful considering that they never even mention this. A better method could possibly to make all Imperial Edition items untradeable and sellable for 0 gold.
This has been known since PC Launch. Its not news and its not shocking. Everyone thats owned a PC version of the Imperial Edition or anyone that cared to look into it (plenty of old threads on it from PC Launch) knew that this is the direction they went.
I really dont see the issue here. Just split up the items between you and whomever is also using the account. Next time do a little more research into your purchase.

So you actually use two (2) PSN accounts right? If so, it would safe to logically assume each account needs their own copy.

Are you not paying for 4 xbox live accounts though? Why should 4 people pay to be able to play online with their own friends list and not just simply all add them onto one?

Oh I'm well aware I can just buy the perks, but considering I just used all my money on the game itself I can't really rebuy it. Not to mention that we also have two more brothers who use the console so we would have to buy the perk 3 more times.
I bought the IE and wouldn't ever have thought it would be shared across accounts. Nor should it. They haven't mislead or cheated anyone, you just assumed something and we're wrong. Not having a go at you for assuming it, you have your own reasons but at the same time, they haven't cheated you in any way. If in doubt, check first.

So if you had known, what would that have changed? Would you not have bought the imperial edition? You might be able to get a refund on that if you request, and then just have the base game and lose all of the benefits. Or if it's just because you shared- then you can share getting another.
If neither of those is applicable, then I don't think it was the communication that's your problem. You just want it to be some way that it's not. That's pretty unsolvable.
But don't hide behind the lack of understanding/communication.
